陈娇和林伯明
在2007年9月，20岁的陈娇（音译）嫁给了年长她三岁的林伯明（音译）。随后她通过家庭团聚类移民担保她的丈夫申请永久居留，但是林的申请却被拒绝。因此陈提出了上诉。
Jiao Chen was 20 years old when she married Bo Ming Lin, three years her senior, in September 2007. She sponsored her husband for permanent residence under the family class, but Mr. Lin’s application was rejected. Ms. Chen appealed the decision.
据陈称，她和林在中国是一起玩大的朋友，从2003年开始恋爱，当时她因为中考失败而感到沮丧。陈表示，在她抑郁时一直在一个24小时全天候营业的网吧里打发时间。
According to Ms. Chen, she and Mr. Lin had been childhood friends in China. Their romantic relationship began in 2003, when she became depressed after failing a high school entrance exam. In her depression, Ms. Chen said she spent her days at a 24-hour internet café.
陈告诉加拿大公民和移民部（CIC）官员，有一天晚上她在网吧通宵上网时，林在网吧里遇到了她并且安慰了她。随后他们一起去麦当劳吃了早餐，在那里他答应做她的男朋友。
Ms. Chen told Citizenship and Immigration Canada (CIC) officials that when she did not return home one night, Mr. Lin found her at the internet café and consoled her. They visited MacDonald’s for breakfast, where he asked to be her boyfriend.
但是当CIC官员询问林是如何与妻子相遇时，他却只字未提网吧。他表示，他和陈是在恋爱近四年后，于2007年5月10日同意结婚，而陈却说她是在4月5日答应嫁给林。
When CIC officials asked the couple how they met, Mr. Lin never mentioned the internet café. He said they agreed to marry almost four years later – on May 10, 2007, while Ms. Chen said she agreed to marry him on April 5.
陈还作证称，她和林在2007年9月16日才同房，但是文件证据却显示他们在9月10日就已经同居在一起。Dana Kean法官写道，当被问及为什么等了近一周才和丈夫发生性关系时，陈表示她“有点保守”和“害怕”。
Ms. Chen also testified that she and Mr. Lin consummated their marriage on September 16, 2007, while documentary evidence showed them living together on September 10. Asked why she waited almost a week to have sex with her husband, Ms. Chen she was “a bit conservative” and “scared,” Justice Dana Kean wrote.
更糟糕的是，还有另外一个提出另一份永久居民申请的人也是来自陈的住址。
More damning, there was another permanent resident application, from a different person, coming from Ms. Chen’s address.
Kean法官写道，陈和第二个申请人“是同事和室友，他们曾一起去中国，并且12天内分别在福清市结婚，他们都是在福州注册结婚。”
Ms. Chen and this second applicant “were co-workers and housemates, and they both travelled to China together and got married in Fuqing 12 days apart,” Justice Kean wrote. “Both registered their marriages in Fuzhou.”
但是陈拒绝透露她与前室友的关系，Kean法官写道：“虽然他们一起生活和工作，并且一起飞到中国和各自的丈夫结婚，但法庭认为这非常难以置信。”
Ms. Chen denied sharing information about her relationship with her former roommate, “although they lived and worked together and took the same flight to China to marry their respective husbands,” Justice Kean wrote. “The tribunal finds this highly implausible.”
陈的上诉因此被驳回。
Ms. Chen’s appeal was dismissed.
